Kota Kinabalu: A trader was fined RM3,000 or four months’ jail by the Magistrate’s Court here, Thursday, for obstructing health enforcement personnel from doing their job.
Tee Hong Lim, 38, pleaded guilty before Magistrate Marilyn Kelvin to committing the offence against one Mohd Azman Maulaha to pouring away water in a container that had mosquito larvae in it and not cooperating with the said personnel.
The offence took place at a house, at Taman Sri Kepayan, here, on June 1, this year at 10.20am.
The charge, under Section 186 of the Penal Code, carries a jail term of up to two years or a fine of up to RM10,000, or both, on conviction.
The facts of the case presented by the prosecution stated that the incident took place when health enforcement personnel and a colleague went to Taman Sri Kepayan to carry out dengue prevention duties following two reported cases of dengue fever in the area.
After inspecting four houses, the team proceeded to Tee’s home and found two containers, a paint bucket and a filter casing, filled with stagnant water containing mosquito larvae.
The complainant informed the occupant that they would be taking water samples from the containers for laboratory testing and requested identification details.
However, Tee refused to cooperate and proceeded to dispose of the containers with the larvae before any samples could be collected.
As a result, the complainant was unable to take the required samples and later lodged a police report over Tee’s actions.
In another case, a 32-year-old driver was released on a two-year good behaviour bond after pleading guilty to assaulting another driver.
Magistrate Wan Farrah Farriza Wan Ghazali discharged Mahady Sham on the bond of good behaviour and set RM1,200 in one surety, after accepting his guilty plea.
Mahadi admitted to voluntarily causing hurt to one Sanjay Ganth on May 15, 2024, at 11.46am at the loading bay section of the serving unit of the Queen Elizabeth Hospital 2, here.
The offence was framed under Section 323 of the Penal Code.
Earlier, counsel Mohammad Syazwan Shah Mohamad Ali, who represented Mahadi, informed the court that their representation letter to the Attorney General’s Chambers had been accepted, and applied for a good behaviour bond for his client under Section 173A of the Criminal Procedure Code, on the ground, among others, that he is a government servant.
Meanwhile, a man was sentenced to two months’ jail for having housebreaking tools.
Md Azzan Amran pleaded guilty before Magistrate Dzul Elmy Yunus to having the tools including two iron cutters, a knife and a saw, on June 8, this year at 12am, at Petagas.
Unrepresented, Azzan requested leniency, admitting that he had made a mistake in choosing his friends.
He was charged under Section 18(e) of the Minor Offences Ordinance, which carries a jail term of up to six months, on conviction.
Deputy Public Prosecutor Akaash Singh, Police Inspectors Yusdi Basri and Mohamad Hamidi Mohamad Hamzah prosecuted.
