TAWAU: A 36-year-old sales assistant was jailed one year and ordered given three strokes of the cane for committing criminal breach of trust involving company funds amounting to RM10,550.
Fadhil Salleh Kasim pleaded guilty before Sessions Court Judge Ahmad Faizadh Yahaya to the charge against him.
He had breached the trust given to him as a sales assistant of a supermarket which entrusted him RM10,550 at 7.30pm on June 7 at the supermarket in Semporna.
Fadhil had withdrawn the cash without the knowledge of his superiors, which constituted a breach of legal contract.
He was charged under Section 408 of the Penal Code, which carries a punishment for criminal breach of trust by a person in a position of trust.
According to the facts of the case, at 12.40 pm on June 12, a complainant, who was also an assistant manager, discovered during a check that there was a shortfall in the RM20,000 kept in the cash box.
A review of CCTV footage revealed that the accused had taken money from the safe on June 7 without the company's permission.
As a result, Fadhil was found to have committed the offence by withdrawing RM10,550 that had been entrusted to him.
The court ordered jail sentence from the date of arrest on June 18.
Deputy Public Prosecutor Muhammad Haikal Hazwan Md Yatin appeared for the prosecution while Fadhil was not represented.
