Kota Kinabalu: An unemployed man was fined RM2,000 or jailed seven months by the Magistrate’s Court here Monday for filing a false report that his aunt’s car had been stolen when it had actually been seized in a burglary investigation.
Hariff Nazwan Jasofa, 30, pleaded guilty before Magistrate Marilyn Kelvin to giving false information to a police constable at the Public Complaints Counter at the Kota Kinabalu Police Station, at 12.45pm on July 1 this year.
The charge stated that Harrif told Constable Steve Novasollic Along that a white Perodua Axia in his possession had gone missing, intending for the officer to believe the statement.
The charge under Section 182 of the Penal Code, carries a jail term of up to six months or a fine of up to RM2,000, or both, on conviction.
The facts of the case presented by the prosecution stated that he complainant lodged a police report following his investigation, during which Hariff was found to have given false information when making his report.
In his false report, Hariff claimed that the car was stolen at Taman Putrajaya Telipok.
Investigations later revealed that the vehicle had not been stolen, but had been seized by police on June 19 at Kepayan, in connection with another case under Section 457 of the Penal Code involving housebreaking.
Hariff admitted that he had made the false report because he feared his aunt, the registered owner of the car, would be angry if she found out that he had used it with friends to commit a burglary, which led to the vehicle being confiscated by police.
Hariff had also made a follow-up report on the same day, claiming his MyKad, which was in the car, had also been stolen.
In another case, a 43-year-old man was charged with stealing 13 cans of Carlsberg Special Brew worth RM89.70 from a convenience store.
Majilik Kuanang pleaded not guilty to the offence allegedly committed at 99 Speedmart, 88 Marketplace, at 11am, on July 29 this year.
The charge, under Section 380 of the Penal Code, carries a jail term of up to 10 years and may also involve a fine or whipping, on conviction.
The court fixed Oct 1 for pre-trial case management and released the accused on a bail of RM1,600 in two sureties.
Meanwhile, a 34-year-old man claimed trial to attempting to steal an electrical component from Sabah Electricity Sdn Bhd’s (Sabah Electricity) storage site.
Andry was alleged to have tried to steal a busbar component inside a feeder pillar by opening it with a screwdriver at 12.59am on March 3, 2024, at the Sabah Electricity storage facility in Tanjung Aru, Kota Kinabalu.
The charge was framed under Section 379 of the Penal Code, read together with Section 511 of the same Code.
The court set Oct 8 for ptcm and granted the accused RM5,000 bail in two sureties. Inspector Yusdi Basri prosecuted.
