Kota Kinabalu: A 47-year-old man was jailed six years and ordered to get three strokes of the cane for repeatedly taking syabu.
Sessions Court Judge Marlina Ibrahim handed the sentence to Jamais Luyang who admitted to the charge against him, Tuesday.
Jamais was found taking the drug at 12.10am on July 4 this year after testing positive at the Beaufort police station. He has two similar records previously.
The offence, under Section 39C(1) (b) of the Dangerous Drugs Act, carries a jail term of between five and seven years, and whipping, on conviction.
After completing the jail sentence, Jamais was ordered to be placed under police supervision for three years.
The two previous convictions that Jamais had committed were on Nov 21, 2017 where Jamais was jailed seven months by the Beaufort Magistrate’s Court, and another on Sept 13, 2018, where he was ordered to pay a fine of RM2,700 or eight months’ jail.
During mitigation, Jamais who was not represented, asked for leniency.
Deputy Public Prosecutor DK Afiqah Alya, who appeared for the prosecution, urged the court to impose a deterrent sentence on the grounds that it was serious offence.
