Kota Kinabalu: A 52-year-old man charged with three counts of possessing cannabis and syabu will know his fate on Dec 12 this year.
Sessions Court Judge Elsie Primus set the date for Gordon Chong Set Foh after the defence closed its case, having called two witnesses.
On the first count, Chong is accused of possessing 194 grammes of cannabis at 9.20pm on Dec 24, 2022, at a car park in the Funky Farm Food Court, Lorong Cyber Perdana, Kg Kepayan, near here.
The offence, under Section 6 of the Dangerous Drugs Act (DDA) and punishable under Section 39A(2) of the same Act, carries a jail term of between five years and life imprisonment, and at least 10 strokes of the cane, upon conviction.
On the second count, he allegedly possessed 15.23 grammes of cannabis at the same place and time, while on the third count, he is accused of possessing 3.36 grammes of syabu.
The prosecution called five witnesses during the trial, and Chong was ordered to enter his defence on Aug 29 this year after the court found that the prosecution had established a prima facie case.
Deputy Public Prosecutor Nurul Shafeerah Mad Iskim appeared for the prosecution, while Chong was represented by counsel Datuk Nelson Wences Angang.
