Kota Kinabalu: A 33-year-old man was jailed a total of 14 months and fined RM1,000 by the Magistrate’s Court, here, for criminal intimidation and assault on his in-laws in one drunken incident during a wedding celebration.
Mohamad Nazri Norsinin pleaded guilty before separate Magistrates to committing the offence on Oct 26, this year.
On the first charge, Nazri was jailed nine months by Magistrate Marilyn Kelvin for criminally intimidating one Rahmat Hidayat Arif, 22, and Rebecca Lazarus, 22, by saying, “Kamu tunggu ah... saya bunuh kamu” (“You wait... I’ll kill you”), at 6.30pm, outside the Sacred Heart Parish Hall, Inobong, Penampang.
For the second charge, Magistrate Dzul Elmy Yunus jailed him two months for voluntarily causing hurt to his brother-in-law Rahmat, at the same time and place.
For the third charge, Nazri received three months’ jail and a RM1,000 fine, in default two months’ jail, for assaulting his wife, Norita Jita Lazarus, 31, at 7pm on the same day at Kg Inobong, Penampang.
The court heard from the prosecution that during the incident, Nazri, who was drunk after consuming alcohol at the wedding reception of his wife’s sister and her husband, Rahmat, confronted Rahmat, who was the groom at the event.
Nazri suddenly headbutted Rahmat and hurled abusive words at him.
Despite the provocation, Rahmat did not retaliate.
When Nazri realised Rahmat had called the police, he tried to flee by driving his car out of the compound, ramming into the metal gate.
He then threatened Rahmat’s wife, Rebecca, before reversing his vehicle and hitting the same gate again, which was being lifted by Rebecca and several guests at the time.
The assault on his wife occurred about half an hour later while they were on their way home.
Nazri, still under the influence of alcohol, repeatedly punched Norita in the head inside their car, upset that her family members had earlier stopped her from joining him as he was drunk.
Norita sustained swelling and bruises on her head and right thumb.
She later lodged a police report and filed for divorce in the Syariah Court.
Nazri was later arrested the same evening at the Penampang Police Station.
Unrepresented, Nazri requested leniency, citing that he has six school-going children and was remorseful of his action.
The prosecution applied for a deterrent sentence.
Marilyn ordered Nazri’s sentence to run from the date of his arrest, while Dzul ordered him to serve the sentence on the second and third charges concurrently.
The first, second and third charges were respectively framed under Section 506 of the Penal Code, Section 323 of the Penal Code, and under Section 323 read with Section 326A of the Penal Code.
