Kota Kinabalu: A 41-year-old undocumented Filipino, Raj Sapari, was on Tuesday jailed 14 months by the Magistrate’s Court for injuring a man with a pair of scissors three months ago.
Raj pleaded guilty before Magistrate Marilyn Kelvin to attacking Matt Shazeeley Mohd Salleh at 3.39am on Sept 9, at a house in Taman Suria Kepayan, Kobusak.
He changed his plea to guilty under Section 324 of the Penal Code, which carries a penalty of up to 10 years’ jail, a fine, whipping, or any combination of the penalties.
Prosecutor Inspector Yusdi Basri told the court that Matt lodged a police report at 8:25am the same day, alleging that Raj had trespassed into his compound and attacked him.
Investigations revealed that Matt had seen Raj wandering in his compound without permission, and when confronted, Raj lunged at him with a pair of black scissors.
A struggle ensued, leaving Matt with injuries that required three stitches on his right shoulder and two stitches below his left thumb. CCTV footage confirmed Raj’s entry into the compound and the attack.
Raj’s sentence is to run from the date of his arrest.
He will be referred to the Immigration Department upon completing his jail term.
In a separate offence, Raj also pleaded guilty to possessing syabu. Under Section 15(1)(a) of the Dangerous Drugs Act, this offence carries a maximum fine of RM5,000 or up to two years in jail.
The court sentenced him to eight months’ jail, to run from the date of his arrest.
Meanwhile, in another case, 21-year-old Vickey Dee Bond Joudin was fined RM1,800, or one month’s jail, for engaging in public gambling.
She admitted to participating in online 4D top-up gambling at a grocery shop on Jalan Kionsom Lama, Inanam, at 4.34pm on Nov 21.
The offence falls under Section 7(2) of the Common Gaming Houses Act 1953, which carries a maximum RM5,000 fine, up to six months’ jail, or both.
Police, acting on information under Op Dadu, conducted surveillance before approaching Vickey and seizing items used for the gambling activities, including RM108 in cash.
Vickey confessed to engaging in the gambling activity at the premises for about two months. The court ordered the seized cash to be forfeited to the government.
