Jailed for keeping stolen motorcycle 
The charge under Section 411 of the Penal Code carries a jail term of between six months and five years and liability of a fine on conviction.
Kota Kinabalu: The Magistrate’s Court here jailed a man for eight months and fined him RM2,000 or two months’ imprisonment for keeping a stolen motorcycle.

Rodimar Kimar pleaded guilty before Magistrate Dzul Elmy Yunus to having a stolen Nova 125 Aveta scooter belonging to one Noor Hidayuhanna Rebbin, at a bushy area by the roadside at the entrance to Kg Cenderakasih, Kolombong, on Oct 7, this year, at 11.40pm.

The prosecution informed the court that the complainant lodged a police report at 9.45am on Oct 4, after discovering that her motorcycle, which had been parked at the parking area of Block A, Seri Warisan Apartment in Inanam, was missing.

Investigations showed that the complainant last saw her motorcycle at 11pm, on Oct 3.

When she went to use it at 8am the next day, she realised it had been stolen.

Acting on information received, a police task force arrested Rodimar at 11.40pm on Oct 7. 

Following directions given by Rodimar, the police recovered a red Nova 125 Aveta scooter, which was later identified by the complainant as her stolen property.

Unrepresented, Rodimar appealed for leniency and asked that the sentence run from the date of his arrest, assuring the court he would not reoffend.

The prosecution sought a deterrent sentence and applied for Rodimar to be referred to the Immigration Department.

The court ordered Rodimar to serve the jail term from the date of his arrest and directed that he be referred to the Immigration Department after completing his sentence.
