Kota Kinabalu: A company owner was fined RM3,000 or jailed three months by the Magistrate’s Court, here, Tuesday for operating a private agency without a valid licence.
Siti Sharizah Samsudin, 38, pleaded guilty before Magistrate Dzul Elmy Yunus to operating a private agency under the name of Syarikat Perkhidmatan DK without a licence issued by the Home Ministry at a retail premises in KK Plaza, here, at about 2.30pm, on June 26, 2025.
Siti Sharizah was charged under Section 3(1) of the Private Agencies Act 1971, punishable under Section 14 of the same Act, which provides a maximum fine of RM10,000 or imprisonment of up to three years, or both, on conviction.
The court was informed by the prosecution that enforcement officers from the Home Ministry conducted an inspection at the premises on June 24, 2025, and found four security guards and a supervisor who claimed to be employed by Syarikat Perkhidmatan DK.
Checks through the Home Ministry’s eSIMS system revealed that the company was not registered and was operating illegally without a licence.
The security guards also failed to produce valid security passes or comply with uniform requirements.
Further investigations showed that Siti Sharizah was the director and owner of Syarikat Perkhidmatan DK.
Pleading for leniency, Siti Sharizah said she had many commitments and that she was a first offender.
