Man loses second attempt for bail

Kota Kinabalu: A lawyer's attempt to secure bail for his client on the grounds that he needed to support his wife following the loss of their child did little to persuade the court here Tuesday.Sessions Court Judge Indra Ayub turned down Muhammed Salleh, 27, who stands charged with living off the earnings of a Filipina prostitute. It was his second attempt to apply for bail, the first of which was objected to by the prosecution when he was first charged with the offence.

In Tuesday's proceedings, Deputy Public Prosecutor Mohd Khairuddin Idris proposed a bail amount of RM4,000 in a local surety when his case was brought up for case management but Indra decided that Muhammed (pic) should remain under remand.

Indra fixed Aug 4-5 this year to hear the case.

Muhammed had, on March 22 this year, pleaded not guilty to committing the offence at 12.35am on March 12 this year at a car park in a hotel along Jalan Bundusan, Penampang.

The offence under Section 372A of the Penal Code carries a jail term of up to 15 years and whipping or fine, on conviction.

Earlier, counsel Luke Ressa Balang, who represented Muhammed, applied for bail saying Muhammed's wife had given birth before he was arrested.

Balang added that after three months, their baby had passed away and that the wife now needed his support.

In the Magistrate's Court, a man pleaded not guilty to two counts of having a knife without a permit in the public and also stolen items.

Mohd Khairul Abbas made the plea after he was brought before Magistrate Stephanie Sherron Abbie.

On the first count, Mohd Khairul is accused of possessing the knife at 1.30am on April 20, this year at Kg Likas area, here.

On the second, he allegedly had the stolen items, namely, a necklace, a wristwatch, earrings, two gold sales receipts, two handphones and USD notes at the same place and time.

The court set June 13 for case management on the first count and June 1 for the second count.

Chief Inspector Lim Swee Beng prosecuted while Mohd Khairul was not represented.

No bail was offered to Mohd Khairul as he has no valid document.
