Trio receive 20 years, 3 strokes each for armed gang robbery

Kota Kinabalu: Two foreigners and a local man were sentenced to 20 years' jail and ordered given three strokes of the cane each for armed gang robbery.Sessions Court Judge Ainul Shahrin Mohamad handed the sentence to Muhd Fazrul Timothy Abdullah, 32, foreigners Mohd Hisham Albani, 30, and Aliasar Mohd Salleh after they were convicted of the charge on Wednesday.

Ainul ruled that the defence failed to raise any reasonable doubt in the prosecution case.

The trio were found guilty of robbing one Sheila Usop, 31, with a sword, a knife and a crowbar, of various items worth RM80,000 at 4pm on Dec 22, 2014 at a house in Taman Salut Perdana, Sepanggar.

The offence under Section 395/397 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

After serving the jail sentence, Mohd Hisham and Aliasar were ordered referred to the Immigration Department.

During mitigation, counsel Datuk Norbert Chin, who represented Muhd Fazrul, asked for lenient sentence saying that his client was remorseful and wished to apologies to all relevant parties, including the victim.

Counsel Muhammad Amirul Amin, who defended the other two, also asked for a light sentence, telling the court that was their first offence and they promised not to repeat any offence in future.

However, Deputy Public Prosecutor Akmazatul Mohamed Nawi urged the court to hand down a deterrent sentence, submitting that the crime had traumatised the victim.

She added that the court should consider the loss suffered by the victim, adding that although most of the items robbed were recovered from the trio, some of them could not be used anymore.

Meanwhile, in the Magistrate's Court, a 19-year-old man pleaded guilty to molesting a woman.

However, Magistrate Stephanie Sherron Abbie deferred Muhammad Izzat Jupri's sentencing to Aug 10 pending his social report from the Welfare Department.

Izzat is accused of fondling the woman's left breast at 4pm on July 11 at a hotel here.

He was released on bail. Chief Inspector Lim Swee Beng prosecuted.
