40 illegals are sentenced

Kota Kinabalu: A total of 40 foreigners were sentenced by the Sessions Court here Thursday for staying in the State illegally.The Filipinos, Indonesians and Pakistanis, aged between 19 and 52, who were brought before Judge Elsie Primus pleaded guilty to committing the offence at separate locations here, Penampang, Keningau, Tenom, Telipok and Inanam on July 16 and 17.

They were Zahid Ali, Ashfaq Ahmad, Yunus Juma, Asman Abdullah, Acoh Karim, Ajon Ismail, Omar Ghani, Norkari Jimmy, Dani Pasa, Rude Sampe, Milha Hasilun, Rahman Hasilun, Suraida Nakil, Mahadi Said, Supian Aspi, Retro Marjano, Nor Siti Danilo, Rosalin Anni, Janine Jaapal, Armalyn Matli, Melsa Mahmud, Nur, Maslina Akan, Arman Tamin, Lan Barsali, Erwin Andianto, Mustail Maad, Pelyam Melyam, Adi Aripin, Abd Rahman Alano, Titingan Panjang, Munir Main, Hairuddin Amiruddin, Abdulla Adol, Kadil Sabiala, Jasning Waridi, Suderso Pinsarlan, Pardi, Manan Andulong and Jolly Masillam.

Zahid, a Pakistani, was ordered to pay a fine of RM10,000 or three months' jail.

He had earlier begged for a fine, saying his brother in Likas would pay the fine.

Zahid also claimed that he had a passport but the prosecution informed the court that there was no endorsement in his passport on entering the State.

When asked by the court as to why he did not have his passport endorsed, Zahid replied that there was no immigration counter when he entered the State through Lawas from Sarawak, adding that he paid RM160 for a taxi from Lawas to Sipitang on July 2.

The other 39 were sentenced three months' jail each and 24 of them were ordered caned once.

They were all charged under Section 6(1)© of the Immigration Act 1959/63, which provides for a jail term of up to five years, or a fine of up to RM10,000, on conviction.

Meanwhile, seven foreigners were also penalised for overstaying.

Victorio Feria, Raees Khan, Muhammad Qasim, Roni Ballek, Yulius Tandi, Sumardi Markus and Marjid Nakil admitted to overstaying in the State between two months and 16 years.

Victorio who had overstayed here for 16 years, was jailed six months, Qasim was fined RM10,000 or three months' jail while the rest were handed three months' jail each.Immigration prosecuting officers Rizya Hawella Jurat and Ahmad Nasir and Chief Inspector Lim Swee Beng prosecuted.
