Cop's appeal to be heard March 20

Kota Kinabalu: The Court of Appeal will on March 20 next year hear the appeal by a Detective Corporal against his conviction and jail sentence of seven years for intentionally omitting information related to terrorist acts.Justices Dato' Tengku Maimun Tuan Mat, Datuk Dr Prasad Sandosham Abraham and Dato' Zabariah Mohd Yusof fixed the date for Corporal Hassan Hj Ali Basari, 63, on Monday.

The court had earlier struck out the notice of motion for a stay of the appeal hearing applied by Hassan's counsel Ram Singh.

Ram applied for a stay of the proceedings until the completion of the appeal record and grounds of decision on the Lahad Datu intrusion case are served on them.

He said they would apply for fresh evidence on the issue of interception.

However, Deputy Public Prosecutor Zhafran Rahim Hamzah objected to the application on the grounds that the application was not relevant to the present appeal.

Hassan, a Bajau who was attached to the Lahad Datu Special Branch, was on Aug 6, 2013 sentenced to seven years' jail after he was found guilty by the High Court of committing the offence between January 2013 and March 3 the same year in the office of the Special Branch chief at the Lahad Datu Police Headquarters.

The charge, under Section 130M of the Penal Code carries a jail term of up to seven years or fine or both on conviction.

Meanwhile, in the Magistrate's Court, 24-year-old Filipino was sentenced to three months' jail for trespassing.

Lajid Abdul admitted before Magistrate Jessica Ombou Kakayun to committing the offence at the construction site of the Likas Bay public park's phase two near here with intention to steal at 8.30pm on Oct 22.

He was charged under Section 447 of the Penal Code.

Inspector Azaman Hamat prosecuted.
