Pakistani denies both charges

Kota Kinabalu: A 35-year-old Pakistani was charged with misappropriating RM55,028 as well as cheating another man of RM70,990.Wakil Khan Waris Khan, a passport holder, pleaded not guilty to both charges before Magistrate Stephanie Sherron Abbie. On the first count, he is accused of misusing the money between May 26, 2017 and June 2, 2017 at the Golden Buffalo Enterprise in Kg Bahang, Penampang.

The offence under Section 403 of the Penal Code carries a jail term of between six months and five years, and with whipping or with fine, or with any of such punishments, on conviction.On the second count, Wakil allegedly cheated one Wee Lip Hing @ Edwin, 56, by deceiving the latter with a cheque for RM70,990 in which he (Wakil) knew that the account had been closed.Wakil's act had caused Wee to give him 3,000 packets of rice between 10am and 5pm on April 18, 2017 at Syarikat Istiwawasan Sdn Bhd, Kolombong and Kedai Madinah Store Sdn Bhd in Bandaran Berjaya.The charge stated that, Wee as a representative of Syarikat Istiwawasan Sdn Bhd, had send the rice to Wakil.

Wakil allegedly committed the offence together with another accused Syed Hassan Sawab who was not present during the proceeding.The court set March 26 for mention and no bail was offered to Wakil following an objection by the prosecution.

Abbie also issued the Summon To Accused (STA) to Syed Hassan and fixed the same date as Wakil for review of the STA.Earlier, counsel Kimberly Ye who represented Wakil, asked for a bail to be granted to her client, saying that Wakil is married to a local and living in Keningau.Ye also told the court that Wakil also has a brother staying in the State.Stay up-to-date by following Daily Express’s Telegram channel.
