Men in statutory rape cases to know fate December 7
The 42-year-old man is accused of raping the 10-years and 10-months-old girl who is his niece, at 8am on Sept 30, 2020 at a room of a house in a village in Kota Marudu.
Kota Kinabalu: Two men, charged separately with raping their underage relative, will know their fate Dec 7 this year.

Sessions Court Judge Elsie Primus set the date for the men aged 42 and 31, when the defence closed its case after calling two witnesses.

The court also fixed cross submissions on or before Nov 21 and cross reply on or before Dec 1, while on Dec 2 for e-review to monitor the filling submissions from both parties.

Meanwhile, the 31-year-old man allegedly raped the same girl, who is his sister-in-law, at noon on the same day in the bushes of a palm oil estate at the same village in Kota Marudu.

The offence, under Section 376(3) of the Penal Code, carries a jail term of between eight and 30 years, and whipping at least 10 strokes, on conviction.

On Sept 29 this year, the duo was ordered to enter their defence after the court ruled that the prosecution had established a prima facie case against them.

The prosecution had called eight witnesses during the prosecution stage.

The men were remanded further.

Deputy Public Prosecutor Mas Izzaty Lokman conducted the prosecution while counsel Adam George Aludah defended the men.

In another case, two men were jailed five years each for repeating to taking syabu, respectively.

Ali Mekahil and William Soungim pleaded guilty separately before Sessions Court Judge Azreena Aziz.

Ali was jailed five years for taking the drug on July 9 after testing positive for drug at the Beaufort police station and he has several conviction records for taking the drug.

Meanwhile, William was sentenced to five years jail and ordered to get a stroke of the cane for taking the drug on July 15 after his urine was tested positive for drug in Penampang police station.

William also have several conviction for taking the drug.

The duo was ordered to serve the jail sentences from the date of their arrests and placed under police supervision for two years after completing the jail sentence.
