Kota Kinabalu: The Magistrate’s Court here Wednesday jailed a man four months for committing mischief by cutting cables belonging to a telecommunications company.
Magistrate Dzul Elmy Yunus meted out the sentence to Ahmad Azhar Azrin, who pleaded guilty to committing the offence on March 13, this year, at 11.30am, by the roadside of Jalan Penampang, Lorong Starland, Jalan Penampang Baru, Penampang.
Unemployed Ahmad was jointly charged with fisherman Salir Laidin, 30, and a stable worker Md Hiksan Jamlie, 23, who both pleaded not guilty to the charge under Section 431A of the Penal Code, which carries a jail term of up to two years or fine or both, on conviction.
The court fixed May 26 for pre-trial case management (ptcm) on the case of Salir and Hiksan and offered them bail of RM2,000 in two sureties each.
In Ahmad’s case, the prosecution in tendering the facts of the case, informed the court that a police team along with Tekelom Malaysia patrol staff arrested three men at the open land of the said place for stealing cable there.
Five cable rods belonging to TM and tools used to cut the cables were also seized.
Further investigations revealed that Ahmad admitted to being involved in the theft and cutting of underground TM cables a few months ago.
Duty Counsel Jagnesh Jaya representing Ahmad, requested a lenient sentence from the date of his arrest citing that he is single and unemployed.
Inspector Mohamad Hamidi Mohamad Hamzah applied a deterrent sentence.
Ahmad was ordered to serve the sentence from the date of his arrest.
In another case, an air conditioner technician was charged with theft.
Md Nizam Abdul Jalil, 31, pleaded not guilty before Magistrate Marilyn Kelvin to stealing eight Jesselton Quay Homestay keys and six access cards belonging to Jesselton Quay Centre on March 15, this year, at 6.15pm, on the 32nd floor of the Jesselton Quay Centre, here.
The charge is framed under Section 379 of the Penal Code.
Marilyn set May 19 for ptcm and released Nizam on a bail of RM1,600 in two sureties.
