Kota Kinabalu: An unemployed man was jailed nine months by the Magistrate’s Court here for keeping a stolen motorcycle.
Napoleus Josili, 30, pleaded guilty before Magistrate Marilyn Kelvin to dishonestly keeping a stolen WMoto WM110 motorcycle belonging to one Dimas Andrian Ansar.
The offence was committed at 1.30pm on December 13, 2025, by the roadside at Kg Pulutan, Manggatal.
The charge, under Section 411 of the Penal Code read together with Section 34, carries a jail term of between six months and five years, and is also liable to a fine, on conviction.
The court heard from the prosecution that the motorcycle had earlier been reported missing on Dec 2, 2025, from an apartment area in Bandar Sierra.
Acting on information under “Ops Lejang”, a police team went to Kg Pulutan in the early hours of Dec 3, 2025, where they observed two suspicious men for about 30 minutes.
Upon inspection, Napoleus was arrested and a motorcycle, which was stolen, was seized.
Duty counsel Lim Ming Zoong, representing Napoleus, pleaded for leniency, stating that he is single and unemployed, and asked for the sentence to run from the date of arrest as he had been in remand.
The prosecution applied for a deterrent sentence.
The court ordered the sentence to take effect from the date of arrest and allowed the motorcycle to be returned to its rightful owner.
In a separate case, a 47-year-old unemployed man was charged with transferring stolen property.
Donald J Molison pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to dishonestly transferring a drum containing used cooking oil belonging to a business premises.
The offence was allegedly committed at 11.20pm on April 19, this year, at house in Kg Kasigui, Jalan Tambunan, Penampang.
The charge under Section 414 of the Penal Code carries a jail term of up to seven years, or a fine, or both, on conviction.
The court fixed June 30 for pre-trial case management and released the accused on bail of RM2,500 in two sureties.
