Accused arrested with fake IC: SB Officer

Kota Kinabalu: An accused in the Lahad Datu intrusion trial Tuesday, had a fake Malaysian identity card when arrested at Kampung Simunul in Semporna, the High Court here was told.Selangor Special Branch (SB) officer Inspector Roslan Sarail said Totoh Hismullah was among four men who were arrested on March 28, 2013 during a cleaning and census operation.

The operation carried out by security forces was focused around an area where a skirmish had occurred on March 2, 2013.

"I found out after the operation that a Naval Special Force (PASKAL) team had arrested four men, who were brought to an open area near a basketball court at the exit of Lorong 5, Kampung Sri Jaya, Simunul," he said.

The SB officer was testifying in the trial of 30 accused persons charged with various offences in connection with the intrusion at Kampung Tanduo, Lahad Datu.

Roslan said the other three men arrested with Totoh had no identification documents on them and all four men were brought to the Semporna police headquarters.

He said upon examination, the accused's identity card was found to be fake.

The witness told the court that Totoh was a suspect in the incident on March 2, 2013 that claimed the lives of six security personnel at Kampung Sri Jaya, Simunul.

He said he was told of Totoh's involvement in the incident at a briefing by Bukit Aman SB senior officer SAC Cheong Koon Kock on the evening of March 27, 2013 at the Semporna police headquarters.

In the dock are 27 Filipinos and three local residents who are facing one to multiple charges of being members of a terrorist group, waging war against the Yang di-Pertuan Agong, recruiting members for a terrorist group or wilfully harbouring individuals they knew to be members of a terrorist group.

They allegedly committed the offences between Feb 12 and April 10, 2013.

Hearing before Justice Stephen Chung continues today (Wednesday) at the Sabah Prisons Department.
