Kota Kinabalu: A 32-year-old gardener was sentenced to four months’ jail and fined RM1,000 or one month’s jail by the Magistrate’s Court here for assaulting a man during a disturbance at a birthday celebration.
Alan Kok Chen Yew pleaded guilty before Magistrate Dzul Elmy Yunus to voluntarily causing hurt to one Elvest Chong at Taman Makmur Ria, Jalan Pulutan, Manggatal, at 7.30pm on June 17.
The offence under Section 323 of the Penal Code carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction.
The court heard from the prosecution that police received a report of a group fight at the said place, on the day of the incident.
Investigations revealed that the victim was celebrating his child’s birthday at his house when several motorcycles rode past the area, deliberately making loud noise by revving their exhausts.
The victim reprimanded the group over their behaviour.
About an hour later, the group returned to the location.
Alan struck the victim on the head with a helmet while several others also assaulted him from different directions.
The commotion ended when the group fled the scene and were chased by the victim and his family members.
The victim sustained injuries to the left side of his head caused by the helmet attack.
In the same court, a 36-year-old unemployed man claimed trial to causing hurt to a woman.
Mohd Azzufardaus Mohd Jaffar pleaded not guilty to committing the offence to one Saniah Suhib at a house in Kg Sembulan Tengah at about 5pm on June 4.
The charge also frames under Section 323 of the Penal Code.
The court fixed Aug 5 for pre-trial case management and released the accused on bail of RM2,800 with additional conditions that he report to a police station once a month and refrain from disturbing the complainant or prosecution witnesses.
