Teacher who refused to teach received excellence award!
According to Jainal, the APC was announced before July 2023 and that award for his hard work for 2022.
Kota Kinabalu: An English teacher who was sued by a former student of SMK Taun Gusi, for refusing to teach English subject in his Form Four class for few months, 11 years ago, received the Anugerah Perkhidmatan Cemerlang (APC) in 2023.

This was revealed during the trial of the suit filed by Siti Nafirah Siman, 26, against Mohd Jainal Jamrin (JJ), 53, SMK Taun Gusi Principal Suid Hj Hanapi (in his capacity as principal of the SMK Taun Gusi), SMK Taun Gusi, Kota Belud District Education Officer, State Education Director, Director General of Education, Education Minister and Federal Government, as the first, second, fourth, fifth, sixth, seventh and eight defendants.

In the notes of proceedings provided by the “Tiada Guru team”, JJ had agreed with counsel Shireen Sikayun who defended Siti Nafirah, that he received the APC in September 2023.

He agreed that he received the APC two months later after the court findings on three former students of the same school who succesfully sued JJ for also prolonged absenteeism to teach them in class.

However, JJ said the APC was for his work in 2022.

It also stated that JJ also agreed that so far no disciplinary action had been taken on him even after the court findings in July 2023.

However, he stressed that he is still waiting for the action taken on him.

JJ disagreed that the fact no disciplinary action was taken against him until today despite the Court decision in July 2023 and the fact that he even bagged the APC award two months later, he was emboldened to come to Court unprepared because he know whatever the outcome of the matter here there would be no untoward consequences occurring to him.

According to JJ, the APC was announced before July 2023 and that award for his hard work for 2022.

JJ also stated that he “tidak aware” the 2023 High Court Judgment confirmed he was not a credible witness.

He also stated that he has documentary evidence to prove his full year’s attendance as he testified in his EIC, but then confirmed that in fact he has no documentary evidence.

JJ also agreed that he threatened to kill one Cikgu Nurhaizah and ETA Ibrahim during the Aug 24, 2015 PPD meeting saying that he did so because he was angry.

He agreed that was a threat but that nonetheless as both of them are still alive in 2026.

JJ will continue his re-examination July 14 via Zoom before High Court Judge Datuk Ismail Brahim.

Senior Federal Counsel Jesseca Daimis acted for the defendants.

In the suit, Siti Nafirah was seeking, among others, a declaration that the defendants are in breach of their statutory duty under the Education Act by failing to; ensure that she is taught the English language during the period of Feb 2015 to Oct 2015; prepare her for examinations as prescribed under the Education Act.

She was also seeking a declaration that the defendants are in breach of their duty under Regulation 3C, 25, 26 Public Officers (Conduct and Discipline) Regulations 1913; a declaration that the act complained off by the defendants amounted to misfeasance in public office.

Siti Nafirah was also seeking a declaration that the defendants have violated her constitutional right to access to education guaranteed to her under Article 5 read together with Article 12 of the Federal Constitution, damages, costs and any further and other relief which the court may deem fit to grant.
