Kota Kinabalu: The Magistrate’s Court here fined a farmer a RM5,000 or three months’ jail for stealing 71 boxes of mosaic tiles from a construction site.
Richardo Racha pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to stealing 71 boxes of Royal-brand mosaic tiles belonging to K.T.I. Sdn Bhd at the construction site in Lok Kawi camp, Putatan, at 8.20am on June 28.
The charge under Section 379 of the Penal Code carries a jail term of up to seven years, or a fine, or both, on conviction.
The prosecution told the court that on the said day, the complainant entered Lok Kawi camp through the rear entrance and noticed two Toyota Hilux vehicles leaving the area, while a third vehicle stopped after its driver saw the complainant’s vehicle.
Upon inspection, the complainant found a large quantity of mosaic tiles in the vehicles and confirmed that they belonged to K.T.I. Sdn Bhd.
The complainant later located the two other vehicles parked by the roadside in front of the Lok Kawi temple, where further checks confirmed they were also carrying the company’s mosaic tiles.
In a separate case, a Chinese national man claimed trial to using a forged e-boarding pass.
Chang Ye, 54, pleaded not guilty before Magistrate Marilyn Kelvin to fraudulently using as genuine a forged AirAsia e-boarding pass for a Sandakan-Kota Kinabalu flight dated June 26.
The offence allegedly took place at Arrival Hall 3 of the Kota Kinabalu International Airport (Domestic Sabah), at 11.55am, on June 26.
The charge is framed under Section 471 of the Penal Code.
The prosecution applied a pre-trial case management date and objected bail while the accused, through a counsel requested bail.
The court fixed Aug 13 for pre-trial case management and released the accused on RM2,800 bail with two sureties.
The court also ordered him to surrender his passport to the investigating officer and report to the investigating officer once a month pending disposal of the case.
