Kota Kinabalu: A 60-year-old man was jailed a total of 18 months by the Magistrate’s Court here on Friday on two counts of threatening and assaulting a man.
Mahmud Mohd Noh pleaded guilty before Magistrate Marilyn Kelvin to both charges committed at Hotel Gemilang here, at 6am on May 15.

On the first charge, Mahmud was sentenced to eight months’ jail for threatening to cause the death of one Md Nazrin Saimie.
The offence under Section 506 of the Penal Code carries a jail term of up to seven years, a fine, or both, on conviction.
On the second charge, Mahmud was handed 10 months’ jail for voluntarily causing hurt to the same victim at the same place and time.
The offence under Section 323 of the Penal Code is punishable with imprisonment for up to one year, a fine of up to RM2,000, or both, on conviction.
The court ordered Mahmud to serve both sentences from the date of his arrest.
The prosecution told the court that the complainant lodged a police report after he was assaulted and threatened by Mahmud at the back staircase of the hotel.
Investigations revealed that the complainant was trying to chase Mahmud away after he was believed to have entered the workers’ quarters on the sixth floor of the hotel when Mahmud punched him, causing him to slip and fall down the staircase to the fifth floor.
The complainant suffered pain to his buttocks, waist and back as a result of the fall and the assault.
After assaulting the complainant, Mahmud threatened him, saying “ Saya tumbuk muka kau kasi pecah, kalau saya bunuh kau, mati kau (I will punch your face until it breaks. If I kill you, you will die)”.
Fearing for his safety, the complainant went downstairs and contacted the police.
A patrol team arrived at the scene but Mahmud had already left the hotel.
The complainant was then advised to lodge a police report.
