Afiz was charged under Section 8(1)(e) of the Sabah Minor Offences Ordinance, punishable under Section 8(1) of the same Ordinance, which provides for a fine of RM25, on conviction.
The prosecution told the court that on the said day at the complainant’s rented house, she had reprimanded her former husband for failing to feed and neglecting their pet dog for three days, which led to a heated argument.
During the quarrel, Afiz threatened to beat her, hurled abusive words and threw several items around the house.
He then picked up a machete and swung it towards the complainant, causing her to fear for her safety, although he did not proceed with the attack.
Fearing for her safety, the complainant lodged a police report.
Afiz was then arrested by police at 11.55pm the same day.
In another case, a 33-year-old man was jailed four months and fined RM2,000 or two months’ jail for having stolen property.
Ahmad Abdullah pleaded guilty before Magistrate Dzul Elmy Yunus to dishonestly keeping the stolen items, namely a handphone, an identity card and a Public Bank card, belonging to one Jumaidah Mahmood.
Ahmad committed the offence at a rented room on the fourth floor, in Kg Air here, at 11pm, on July 5.
The offence under Section 411 of the Penal Code carries a jail term of up to five years, a fine, or both, on conviction.
The court heard from the prosecution that the complainant lodged a police report after discovering that her handphone, identity card, bank card and cash had gone missing from her rented room at Kg Air, at 9.20am on July 5.
Police investigations revealed that the complainant had left her room unlocked while taking a shower for about 20 minutes.
When she returned, she did not immediately realise her belongings were missing.
About 10 minutes later, she heard the alarm from her handphone coming from the room opposite hers.
She knocked on the door, but Ahmad took some time to answer and denied having the phone.
The complainant then lodged a police report.
Acting on the information received, police arrested Ahmad at a rented room at the said place and took him to the police headquarters for further investigation.
Deputy Public Prosecutor Kareena Kaur Gill Karamjit Singh and Inspector Dzulfamie Amrin prosecuted.
