Kota Kinabalu: An IMM13 holder, who used his brother-in-law’s MyKad to secure employment as a security guard, was jailed weeks and fined RM1,000 or an additional four weeks’ jail by the Magistrate’s Court for using another person’s identity document.
Elwin Rubin, 28, pleaded guilty before Magistrate Dzul Elmy Yunus to using a MyKad belonging to Mohd Ismie Farizal Sufian at the Criminal Investigation Department of the Kota Kinabalu District Police Headquarters at about 10am on July 14.

He was charged under Regulation 25(1)(o) of the National Registration Regulations 1990, which provides for a maximum jail term of three years, a fine of up to RM20,000, or both, upon conviction.
The court heard that police investigations into a report involving a missing customer’s vehicle at an automotive company found that “Ismie” was recorded as the security guard on duty during the incident.
However, during the investigation, another witness told police that he did not recognise “Ismie” as the security guard employed at the company and produced a screenshot of Elwin’s work roster from his mobile phone.
Further investigations revealed that Elwin had used Ismie’s MyKad details to apply for the security guard position without his knowledge or consent.
In mitigation, Elwin, who was unrepresented, pleaded for leniency, explaining that the MyKad belonged to his brother-in-law and that he had used it to obtain employment as a security guard at the automotive company.
Inspector Mohamad Hamidi Mohamad Hamzah, prosecuting, urged the court to impose a deterrent sentence.
The court ordered Elwin to serve his sentence from the date of his arrest and directed that he be referred to the Immigration Department upon completion of his sentence.
