Kota Kinabalu: A 36-year-old man was charged in the Magistrate’s Court here with trafficking 1,579gm of 3,4-methylenedioxymethamphetamine (MDMA).
No plea was recorded from Adam Reno Nordeen after the charge was read before Magistrate Marilyn Kelvin.
Adam was accused of trafficking the drug at 9.45pm on July 10 at a house in Lorong Kingfisher 3, Phase 2A, Jalan SMC, here.
The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries the mandatory death penalty or life imprisonment and, if not sentenced to death, a minimum of 15 strokes of the cane upon conviction.
The prosecution applied for another mention pending the chemist’s report.
Bail was not offered as the offence is non-bailable.
The court fixed Sept 14 for mention pending the chemist’s report.
Adam was further remanded.
In a separate case, a 35-year-old man pleaded not guilty to assaulting his wife.
Stanley Antonio claimed trial before the same court to voluntarily causing hurt to his wife at 1am on July 17 at an apartment in Bundusan.
The charge, under Section 323 of the Penal Code, read together with Section 326A of the same Code, carries a jail term of up to one year, a fine of up to RM2,000, or both, upon conviction.
Section 326A provides for up to twice the maximum term of imprisonment where the offence is committed against a spouse.
The prosecution applied for a pre-trial case management date and proposed bail of RM5,000 with two sureties, together with conditions that the accused must not disturb or interfere with the complainant or any prosecution witness.
Duty counsel Lim Ming Zoong urged the court to reduce the bail, saying Stanley is a salesman, married with two children and resides in Bundusan.
The court fixed Aug 20 for pre-trial case management and released Stanley on bail of RM1,300 with two sureties, subject to the additional condition that he must not disturb or interfere with the complainant or any prosecution witness.
Deputy Public Prosecutor Ronnie Anthony and Inspector Yusdi Basri appeared for the prosecution.
