Kota Kinabalu: A 61-year-old man was fined RM1,200 or four weeks’ jail by the Magistrate’s Court for damaging his neighbour’s house gate with a hammer.
Wong Chin Fong pleaded guilty before Magistrate Dzul Elmy Yunus to committing mischief by damaging the gate of one Sarah Ann Low, causing RM300 in losses, at Lorong Semangkuk 6, Taman Century, Jalan Penampang Lama, at 6.19am, on July 21.
The offence under Section 427 of the Penal Code carries a jail term of between one and five years, or a fine, or both, on conviction.
The court heard from the prosecution that the complainant discovered her gate had been damaged when she arrived home at about 7.04am.
After checking her CCTV footage, she found her neighbour repeatedly hitting the gate with a hammer before lodging a police report.
Police later arrested Wong and seized a hammer and a shirt.

Investigations found that Wong had damaged the gate with the hammer and the incident was captured on the complainant’s CCTV camera.
Unrepresented, Wong asked for a lenient sentence, telling the court he suffered from high blood pressure and that getting angry would only worsen his condition.
He claimed the complainant had extended her gate into his property, objected to her CCTV camera facing his house and said he did not want the neighbour’s cats entering his compound and defecating there.
In a separate case, a 41-year-old insurance agent was charged with assaulting a septuagenarian woman, who was his fellow condominium resident.
Ong Seng Teng, 40, pleaded not guilty before Magistrate Marilyn Kelvin to voluntarily causing hurt to one Thu Sok Pin @ Pauline Thu, 79, in front of a lift at Jesselton Condominium, at 5.30pm, on April 3 this year.
The charge is framed under Section 323 of the Penal Code.
The court fixed Aug 20 for pre-trial case management and released Ong on bail of RM1,500 in two sureties.
He was also ordered not to disturb the complainant or prosecution witnesses and to report to a police station once a month.
Ong was represented by counsel Jagnesh Jaya.
Counsel Datuk Ram Singh and Prem Elmer Ganasan appeared as watching counsel for the complainant.
