SANDAKAN: A 50-year-old undocumented man was ordered to serve 21 years in prison and receive 25 strokes of the cane after pleading guilty to raping and sexually abusing his 15-year-old biological daughter.
Sessions Court Judge Roslinda Razali handed down cumulative sentences totalling 28 years' imprisonment across two counts, with the court ordering certain terms to run consecutively from his March 2 arrest date.
The court heard that the accused committed the offences at 3am on March 1 at a house in Batu 21, where he assaulted the victim's mother when she attempted to intervene.
Although the accused lacked official identification documents, DNA analysis confirmed his biological relationship to the victim, prompting the court to impose an additional consecutive one-year jail term and two strokes of the cane under Section 27 of the Sexual Offences Against Children Act 2017.
Deputy Public Prosecutor Yuvan Bharathan urged the court to impose a severe sentence as a public deterrent, highlighting that the accused had violated his duty of care as a father.
