Kota Kinabalu: A 26-year-old man was fined RM8,000, or 12 months’ jail, by the Traffic Court here for careless and inconsiderate driving.
Mohd Syahrulnizam Erna pleaded guilty before Magistrate Marilyn Kelvin to riding a Honda Vario motorcycle without due care and attention to other road users at Jalan Tuaran near SJKC St James here on July 9, 2025.
The offence under Section 43(1) of the Road Transport Act 1987 carries a fine of between RM5,000 and RM10,000 and imprisonment of up to 12 months upon conviction.
The court heard from the prosecution that investigations found the accident occurred at about 7.28pm and involved Syahrulnizam’s motorcycle, a Toyota Corolla Cross driven by a woman, and a Yamaha LC135C motorcycle ridden by the late Roy Markus at Jalan Tuaran.
Syahrulnizam, who was travelling from the city centre towards Telipok, changed from the left lane to the right lane to overtake the Toyota Corolla Cross ahead of him.
While entering the right lane, his motorcycle collided with Roy’s motorcycle, which was travelling straight in the same lane.

The impact caused the Toyota Corolla Cross to veer into the left lane and collide with the rear right side of Syahrulnizam’s motorcycle.
Roy was thrown onto the road and died at the scene.
The post-mortem report stated that Roy died from chest injuries sustained in the road traffic crash, the court heard.
